Principles applicable to the processing of personal data

The processing of the User's personal data shall be subject to the following principles, set out in article 5 of the GDPR and in article 4 and the following articles of Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales:

In any event, at the moment the personal data is obtained, the User will be informed of the recipients or the categories of recipients of the personal data.

However, since the Website cannot guarantee that the internet is impregnable or that there is a complete absence of hackers or others gaining fraudulent access to personal data, the Controller undertakes to notify the User without undue delay when a personal data breach occurs that is likely to result in a high risk to the rights and freedoms of natural persons. Rights arising from the processing of personal data

The User has rights in relation to the Website arising from the processing of their personal data. They may therefore exercise the following rights, recognised in the GDPR and in Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales, against the Controller:

  • Right of access: this is the User's right to obtain confirmation as to whether or not the Website is processing their personal data and, if so, to obtain information about their specific personal data and about the processing the Website has carried out or is carrying out, as well as, among other things, the information available about the origin of that data and the recipients of the disclosures made or planned.

  • Right to erasure(“the right to be forgotten”): this is the User's right, provided the legislation in force does not state otherwise, to obtain the erasure of their personal data when it is no longer necessary for the purposes for which it was collected or processed; the User has withdrawn their consent to the processing and there is no other legal basis for it; the User objects to the processing and there is no other legitimate ground for continuing with it; the personal data has been processed unlawfully; the personal data must be erased in compliance with a legal obligation; or the personal data was obtained as a result of a direct offer of information society services to a child under 14. In addition to erasing the data, the Controller, taking into account available technology and the cost of implementation, must take reasonable steps to inform controllers who are processing the personal data of the data subject's request for the erasure of any link to that personal data.
  • Right to restriction of processing: this is the User's right to restrict the processing of their personal data. The User has the right to obtain restriction of processing where they contest the accuracy of their personal data; the processing is unlawful; the Controller no longer needs the personal data but the User needs it in order to make claims; and where the User has objected to the processing.
  • Right to data portability: where the processing is carried out by automated means, the User shall have the right to receive their personal data from the Controller in a structured, commonly used and machine-readable format, and to transmit it to another controller. Links to third-party websites

The Website may include hyperlinks or links giving access to web pages of third parties other than the Website, which are therefore not operated by LOBBO. The owners of those websites will have their own data protection policies, and are themselves responsible, in each case, for their own rights and their own privacy practices.

Complaints to the supervisory authority

Should the User consider that there is a problem or an infringement of the legislation in force in the way their personal data is being processed, they shall have the right to an effective judicial remedy and to lodge a complaint with a supervisory authority, in particular in the State of their habitual residence, place of work or place of the alleged infringement. In the case of Spain, the supervisory authority is the Agencia Española de Protección de Datos (http://www.aepd.es).

  1. DATA COLLECTED BY THE LOBBO PACKAGE

Type of information the device collects

When a Device is connected to your motorcycle or moped, LOBBO may collect the following categories of information:

  1. Battery status, date of last service and other aspects electronically recorded in relation to the use and operation of your vehicle.
  2. Data of the mobile device to which the Device is linked through the Application.
  3. Data from the Device used to determine the location of your vehicle, including the town and country in which each item is located (provided that, where the law so requires, you have previously given your consent, or there is another lawful ground for processing this personal data).
  4. The travelling speed of your vehicle, including average speed and parking duration.

Your bank details and other financial information that may be necessary to complete the purchase will not be stored by LOBBO under any circumstances. It will be encrypted and used only to carry out the transaction.

In addition to the above, when you use LOBBO, LOBBO may also collect the following information, additionally (where applicable) and in relation to the information set out above: your name and contact details; for example, your address, postcode, country, telephone numbers and/or email address.

The information above (whether on its own or in combination with other information we hold about you) could allow us to identify you personally. This type of personal information is known as “personal data”. Where LOBBO collects such personal data, we will process that information for the purposes described in this Policy.

When you contact us in relation to LOBBO, we may also collect the following personal data:

  1. Your name and contact details; for example, your address, postcode, country, telephone numbers and/or email address.
  2. The reason for your contact.
  3. Information about services you are interested in and/or information necessary for legal compliance.

This information will be collected mainly from you, but we may also collect it, where lawful, from, and combined with, information we may already hold about you, from public sources, external service providers, the government, tax and/or security service agencies, and other third parties.

Use of the data

LOBBO may use the information described in the section Type of information collected for the following purposes:

  1. Answering and/or dealing with a request or query from you.
  2. Improving the functionality and quality of the device.
  3. Administering the LOBBO platform when you have an active subscription, which may include (among other things):
  • Personalising your experience of the App
      • Locating your vehicle by GPS.
      • Sharing the location of your motorcycle and your routes.
      • Accessing data relating to your journeys and/or your driving style, such as data on the vehicle's average speed, parking time, mileage, and GPS.
      • Complying with legal obligations, rules and other good governance obligations; and any other purpose related to the management of your legal relationship with LOBBO.

Where we are required by the applicable legislation to obtain your prior consent in order to process your personal data for the purposes described above, we will do so. The list above may be updated periodically in line with the business needs of «GPS LOBBO TEAM S.L.» and legal requirements. Should this Policy be updated, we will inform you of that update as required by the applicable legislation.

Please bear in mind that as LOBBO is improved and updated, we may have to process your personal data differently from the way set out above. Whenever that happens, we will update this Policy.

Without prejudice to the applicable legislation, we may also process your personal data for other legitimate business purposes, such as management analysis, auditing, forecasting, planning and corporate transactions, ensuring compliance with the applicable laws, compliance with regulatory requirements and with the policies of «LOBBO SL», handling legal claims and related investigation and/or administrative activities, as well as carrying out any applicable record-keeping obligations. We may also process it to establish or exercise our legal rights and to comply with requests from security services and other government agencies or with court orders.

Please bear in mind that while a GPS Device is connected to your vehicle, we may continue to process some of your personal data for the purposes set out above. Therefore, if you no longer wish « GPS LOBBO TEAM S.L.» to process that personal data, you must disconnect or deactivate your GPS Device from LOBBO.

LOBBO may also turn personal data into anonymous data and use it (normally on an aggregated, statistical basis) for research and analysis in order to improve LOBBO, as well as to ensure compliance with the conditions set out in the Legal Notice and in the applicable law. This may include developing tools and algorithms that help this Website guarantee the confidentiality of the personal data it collects. For more information, see the following section, Aggregated information.

Account analysis and service improvement

To forecast how many subscriptions will renew and to improve the service for everyone, we calculate an internal score for each account from data such as the date of your payments, how you use the app (for example, how many days you open it), the status of your device (for example, when it last sent a signal) and whether the notifications we send you reach you. This is profiling within the meaning of the GDPR. We do not use your location or what you write in this calculation.

We do not use this score to decide anything about you. It does not change your price, your offers or the support you receive, and there are no automated decisions. Only authorised staff can look up an account's score, to analyse the service and not to decide anything about you, and every lookup is logged.

App usage analytics. To improve the app we count which screens are used and when the app is opened. We do not use your location for this, and this data is not shared with third parties or used for advertising. The data strictly necessary for the service to work (the app version, technical errors or the notification permission) is processed to provide you with the service.

The legal basis is our legitimate interest in forecasting our activity and improving the service (article 6.1.f of the GDPR). We keep the detail of your account for a maximum of 24 months. You can object at any time from Settings in the app or by writing to privacidad@lobbo.eu: we will stop scoring your account and stop collecting usage analytics that are not necessary for the service, we will delete what has been calculated, and your service will not change in any way.

Aggregated information

Aggregated personal information does not personally identify you or any other LOBBO user. It may be used for statistical analysis and administration, such as trend analysis, actuarial work, product adaptation, risk assessment and analysis of the associated costs of operating LOBBO.

Sharing personal data with third parties

Your personal data will be provided for the purposes described above (or for others that may be notified to you in the future, and provided there is a legal ground for it under the applicable legislation) not only to the «Owner», but also to our external service providers.

Requests from ads and forms

If you leave your details in a form on one of our Facebook or Instagram ads (Lead Ads), Meta passes us what you wrote in it.

  • What data: your full name, email and phone number, your answers to the form questions (for example, which vehicle you want to track), the ad you came from and the date and time.
  • Purpose: contacting you by WhatsApp, phone or email to answer your request, resolve your questions and, if you are interested, prepare a proposal. We also count how many requests each ad brings in to know which ones work, without passing your data to anyone for advertising.
  • Legal basis: pre-contractual measures at your request and our legitimate interest in handling the request you make to us (Article 6.1.b and 6.1.f GDPR).
  • Retention: if you do not become a customer, 24 months from the last contact, unless you ask for erasure sooner. If you become a customer, your account retention periods apply. We do not record calls.
  • Who is involved: Meta (which collects the form and passes it to us) and our telephone carrier, Telnyx, which handles the calls.
  • Your rights: you can exercise them, and object, by writing to privacidad@lobbo.eu.

Virtual assistants with artificial intelligence

LOBBO has two virtual assistants: the one in the online shop (lobbo.eu), which answers questions before you buy and helps you find your way around the website, and the one in the app, which supports customers who have an account. Both are artificial intelligence programs, not people, and you are told so when you start talking to them, as required by Regulation (EU) 2024/1689 on Artificial Intelligence (article 50). They can make mistakes: in case of doubt, what the product pages and these conditions say prevails, and you can always ask for a person to help you by writing to info@lobbo.eu.

Online shop assistant.

  • What data it processes: the text you write and the last few questions of the same conversation, to follow the thread, plus the language of the page. It does not ask you for personal data and has no access to any customer account, so please do not write your name, phone number, registration plate or your device's serial number.
  • What for: answering your query about our products and services and, if you ask, showing you a product, taking you to the right page or adding a product to your basket (always with your confirmation).
  • Legal basis: our legitimate interest in answering the questions you ask us about our products and in preventing abuse of the service (article 6.1.f of the GDPR) and, when the query is part of a purchase you are preparing, taking pre-contractual steps at your request (article 6.1.b).
  • Retention: we do not store the conversation. It is processed to answer you and then discarded; it disappears when you close or reload the page. For each answer we only record usage figures (the number of tokens processed, which is the unit in which use of the model is measured and billed, and its cost), without the text; these figures are kept for 13 months to control spending and do not allow the conversation to be reconstructed.
  • Usage limit: to stop an automated program from abusing the assistant, we count how many questions each visitor asks per day. For this we do not store your IP address, but a code derived from it that cannot be reversed and that is renewed every 24 hours.
  • Who processes it: the answer is written by the Gemini model of Google Cloud (Vertex AI), in a data centre in the European Union (Belgium), in a project dedicated only to this assistant; Google does not use this data to train its models. To find the answer in our knowledge base, the text of the question is converted into a numerical representation with the OpenAI service (United States), which does not use the data of this service for training and may keep it for a maximum of 30 days solely to detect abuse.

App assistant.

  • What data it processes: your messages and, when needed to answer, the data of your account related to the question: your vehicles and their status, your last position or your last journey, and the status of your subscription. It can only look up the vehicles of the account you signed in with.
  • What for and on what basis: providing the support included in the service you have contracted (article 6.1.b of the GDPR). If the assistant cannot solve it, the conversation is passed to a member of the team. In addition, to check and improve the quality of the answers, some conversations are also processed with a second provider (see “Who processes it”) without that second answer reaching you: this comparison relies on our legitimate interest in maintaining the quality of the service (article 6.1.f) and is limited to what is necessary to evaluate the answer.
  • Retention: the conversation is stored in the chat history of your account, like any conversation with our support team, so that whoever helps you can continue it. If you delete it, it is permanently erased after 30 days; and it is also erased when the account is deleted.
  • Who processes it: OpenAI (United States) writes the answers. To check the quality of the assistant, some questions may also be compared with the model of Anthropic (United States), without that second answer reaching you. Neither of them uses this data to train its models, and they keep it in their systems for 30 days at most, solely for security and abuse detection purposes.

Neither assistant makes decisions that produce legal effects on you or similarly affect you: they do not approve or deny contracts, payments or warranties. Those decisions are always made by a person.

Personal data abroad

Part of your data is processed outside the European Economic Area, and we tell you exactly where and with whom. Your customer record, your order and the documents you upload to the vehicle vault are stored in a data centre of Google Cloud in the United States (Iowa region). Your vehicle's positions, on the other hand, stay in the European Union: the location platform is hosted in Germany. The shop is in the Netherlands and the server functions are in Belgium.

These are the providers that process data on our behalf and where they are:

  • Google Cloud (Firebase): database, files and encrypted vault. United States; functions and shop, in the European Union.
  • DigitalOcean: location platform and vehicle positions. Germany.
  • Stripe: payments and card details. Ireland, with a parent company in the United States.
  • Resend: confirmation emails, notifications and invoices. United States.
  • Cloudflare: content delivery network and web security. Global presence.
  • Holded: invoicing. Spain.
  • Truphone (1GLOBAL): connectivity for the device's SIM card. United Kingdom and European Union.
  • Google Cloud (Vertex AI): writes the answers of the shop assistant. European Union (Belgium).
  • OpenAI: writes the answers of the app assistant and helps search our knowledge base for those of the shop assistant. United States.
  • Anthropic: quality comparison of some answers of the app assistant. United States.
  • Teltonika Telematics: manufacturer of the device, only in the event of a return or an update. Lithuania.

Data leaving the European Union does not mean it is left unprotected. These transfers rely on the adequacy decision for the EU-US Data Privacy Framework of 10 July 2023 for the providers certified under it, and on the standard contractual clauses approved by the European Commission (Decision 2021/914) as an additional safeguard. Google acts solely as a hosting provider: it does not look at your data or use it for any purpose of its own, and the vault documents travel encrypted with a key that only we hold.

You can ask us for a copy of those safeguards by writing to privacidad@lobbo.eu. It is a right granted to you by article 15.2 of the General Data Protection Regulation.

Our service providers that are not located within the European Economic Area (“EEA”) may process or access your personal data from jurisdictions outside that EEA. Consequently, people with a connected Device and/or who use LOBBO within Europe should be aware that such recipients could be located in countries or territories outside the EEA and that those may not have adequate data protection legislation equivalent to that of the EEA. In those cases, measures will be taken to protect your rights and personal data as required by the applicable legislation.

It is also possible that the «Owner» or one of our service providers may transfer the personal data of people from other regions outside their own country. By giving consent to the connection of a Device, and without prejudice to any other requirement laid down by the applicable legislation, that consent shall also act as authorisation for the transfer of your personal data as set out in this Policy.

Measures put in place to protect your personal data

Without prejudice to the provisions of the following paragraph, the «Owner» will take measures to protect the security of your personal data in accordance with the applicable legislation. LOBBO will adopt the technical and organisational measures required to protect personal data against any unauthorised access, alteration, transmission, public disclosure, deletion or destruction, as well as against damage and accidental loss or deletion of the personal data.

We cannot guarantee the security of any transmission of personal data over the Internet. Communications over the Internet, such as emails, are not secure unless they have been encrypted. So, although we make every effort to protect that information, we cannot guarantee or ensure the security of any information transmitted to us. Please do not send personal data through the Application or through any LOBBO SL website unless you accept the security risks inherent in the use of the Internet and their implications.

Reviewing, changing and/or deleting your personal data

You shall have the right to request information about the processing of your personal data, to access it, and to request the rectification of inaccurate data or, where appropriate, to request its erasure when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, you may request the restriction of the processing of your data, in which case we will only keep it for the exercise or defence of claims.

For reasons relating to your particular situation, you may object to the processing of your data. LOBBO will stop processing the data, except on compelling legitimate grounds, or for the exercise or defence of possible claims. In particular, you may object at any time to the analysis of your account (see “Account analysis and service improvement”).

Under the right to portability, you have the right to obtain the personal data concerning you in a structured, commonly used and machine-readable format and to transmit it to another controller.

The GDPR rights may be exercised by means of a written communication, enclosing a photocopy of your DNI or equivalent identity document, addressed to the «Owner», Avenida del Paralel 144, 2-1, Barcelona, postcode 08015. You may also exercise them by email at privacidad@lobbo.eu.

If you consider that your rights have not been properly attended to, you have the right to lodge a complaint with the Agencia Española de Protección de Datos.

Record-keeping and information available to you

The data provided is kept for the periods set out in “Retention periods for personal data” and, in any event, for the years necessary to comply with legal obligations. While your subscription is active and the LOBBO device remains connected to your vehicle, we continue to process the data needed to provide you with the service.
